Hello,

Your wife cannot withdraw from the MCD proceedings unilaterally. As you both have jointly filed the petition, you both have to appear before the family court and withdraw jointly. Thereafter, you file for contested divorce and get rid of your wife.

If other party withdraws you can file a case and contest for a divorce if there are really grounds for divorce. If the other party withdraws the case you can state before the court that you are not willing to live with your wife and you want divorce.

hi,
your wife can withdraw the case after filing mutual consent u/s 13-b of h.m act. you make a compromise or settlement
with your wife unless she is agreed no court will pass any divorce to you. you can file divorce on other grounds such as
desertion and cruelty etc.

Dear Client,
If one of the parties did not turn up on the date of adjournment i.e., if did not consent for getting divorce after filing mutual consent petition you must file a separate petition on the other grounds of divorce like cruelty, judicial separation etc.,
