How to stop divorce proceedings and get restitution of conjugal rights

We are belong to Sikh religion. My Husband left me at my parents house in October 2014. After that he was mentally harnessing me and pressurize me for divorce. Due to our cast difference he is asking for divorce.At last I have applied for it but I don't want divorce. How can I stop it and able to get order form court that we should live together. I want to reside with him. I want to save this relationship.

You can file a case of restitution of conjugal rights under section 9 of Hindhu/ Sikh marriage act so that court can order you to live with ur husband and you can withdraw your part of divorce petition from the court . For further action plz contact.

Dear there is no need to give him divorce, if he will file it at his own, you can contest it, he can't get so easily, secondly you claim the residence either rented or if he has his own property, no need to worry..

You said you do not want divorce then why you files divorce case .in spite of divorce if you want to live with your husband you have to file section 9 hma for conjugal right case that you want to live with your husband.

Firstly you have to withdraw the divorce petition filed by you. In case you are desirous of living with your husband then you have to file a petition u/s- 9 HMAct for restitution of conjugal rights. Then the court will also endeavour to unite you.

You can withdraw your petition of divorce from the Court where it is pending, which had already been filed by you under the influence of your husband. and file the petition under section 9 of Hindu Marriage Act 1955 for restitution of conjugal rights.
