How to recover property dowry from husband not giving maintenance

I am a Christian mother of a boy and a girl aged 15 and 14. Husband never gave maintenance but property given as dowry was given in both our names. My parents are no more and now he wants to sell the property and take money in his name. what can i do to get property in my name and children's maintenance since I am jobless and very ill now.

You must immediately lodge a police complaint against your husband as well as file a domestic violence case immediately against your husband with clause of right to residence and tag the said property in the case and moreover you must do it with guidance of a lawyer and make sure you also file a 125 maintenance alongwith it to acquire maintenance for both your children and for yourself.

In order to recover your property you need to move the court and file a case for recovery of your property. However, you will be required to submit any proof of property being given by you to them at the time of marriage.

And to get maintenance you can file a case under section 125 of Cr.P.C along with Domestic Violation Act.

You have many way to compelled your husband to give you maintenance for yourselves and your minor child, you may file case against you husband Under Section 125 CrPC and DVPW act for obtain maintainance.

Hi,
If the property is in both of your name your husband can not sale the property alone. he needs your signature too. You can file a suit claiming maintenance for you as well as your children. For more detailed legal advice I need to discuss the issue in detail with you.
