How to initiate mediation proceedings so as to avoid divorce

02-Jun-2023 (In Divorce Law)
I m married since 5 months. We both are hindu. I have many problems with my hubby and my in-laws. Among them most of of intereference created by his family between us. I demanded my hubby to live separetly from his husband and his in laws. But he refused and demand divorce with me as he said that we cant live together. But we live in joint family and lots of problem created by his in laws and his parents between us. My question is that can if he apply for divorce in court can i contested it or not? As i dont want to divorce in such small problems or silly matters. And i read Somewhere about mediation center. So can i apply for private mediation without going court or not?

Yes for such silly reasons you should not go divorce. The husband and wife relation is not so cheap I guess. Yes you opt for mediation or go for marriage counselling both you have to go before that firstly you both should talk to each other.

There are two ways for divorce
First is consent divorce where you can file divorce petition where as you both will be called for Mediation and then after filing the petition you will go through the mediation and you can save your marriage life if you want to save else after there mediation the divorce will be awarded n you both consent.
And 2nd way is simple divorce with all you grievances.
But I think you are looking for mediation then the first option is good for you where you will get a chance to save your marriage life.

Hi! You may apply to private mediation center, lawyer, firm.but it will solve problem or not that depend on you and your hubby. As you said, you wish to live separately, that may be ground for them to seek divorce as per recent apex court ruling but it need to prove and you can contest divorce proceeding. Thanking you.
