How to initiate mediation in divorce proceedings

Hi , Just wanted to know , I did love marriage last year 30 mar, after 6 month my wife went to their parents and its been 8 months now ... she didn't come back and in between my girl child came ... in apr4 they filed one application in local women cell regarding ... my brother try to rape her ... now case in court as mediation level... now they demand for 10 lakh rupess as a normal class family .. I can not afford so much money ... any other way to resolve ... please advise

Did your brother actually rape her or its a fabricated story .If your brother did not do anything regarding the allegations then u can take the plea of that in mediation centre and prove that this is fabricated story and the compensation demand is also false .

In mediation do not accept false allegations. But mediation for what? Why 10 lakhs. Do not succumb to the pressure.
Besides you must file for RCR U/S 9 of HMA. Any proof of Rape? See me with all papers and you can be correctly advised.

Well in the event your wife is ready for divorce after taking 10 Lakhs, You must go for it. In the event you want to live with your wife, you can tell the mediator, and simultaneously also file an application under section 9 of Hindu Marriage act for restitution of conjugal rights, which even if not able to force your wife back, but will eventually help you in your criminal proceedings.

Sir you should file under section 9 of HMA petition in the court. Court give notice to your wife and given a chance both of you to settle the matter .if your wife refuse to sattle the matter .Then court will decide on marrit.

If the case against your brother is true then arrange the money. if it is false and vexatious then let them file a complaint and you and your brother fight the same. if it false then ultimately you gonna win and then your brother may file a case for defamation and damages against your wife.
