How to get divorce if husband is in USA

23-Mar-2023 (In Divorce Law)

I have been married in India in 2013. After my hindu marriage my In-Laws tried to create difference between me and my husband including harassment and mental torture. Subsequently, we went to USA for his deputation and stayed there from Jan 2014. However, when his parents visited in June 2015, I was again put under sever harassment and mental torture. I tried for 4 months, and finally I had to come back to India to save myself. Now, I would like to get a divorce. I am in India and he is in USA. I have requested for mutual divorce, but he has disagreed to come to India in the near future.

File a suit for divorce on contest and send summon to the USA and Indian address if not service return then publish it in a newspaper in India and get ex-parte hearing if your husband would not contest.

Dear client,
Then file a complaint against him under section 498A of IPC and also a maintenance case under section 125 of crpc. This will put on pressure on him. If not then file alone file contesting divorce case before the District court on the ground of cruelty and disertion. And if he will not appear before the Court then you have to pray before the court for ex-parte hearing. And then court will pass an exparte divorce decree in your favour.
