How to get divorce if divorce proceedings have failed earlier ?

I'm married a women 2014 last week I heared she already married she applied for divorce case dissolved due both not present at court now please tell I need divorce and compensation amount for her possible or not sir

You can file the case against her for nullify of marriage on the ground of cheating about her marital status. Court may not order any compensation in this matter. While filling the divorce petition mention about her divorce case status between her and her former husband.

If the case was disposed for default. Then we have to reopen the case and we have to give attention to court proceedings to avoid default for dismiss. D there is an option for reopen when the case was dismissed earlier.

If both parties are not present during proceedings the petition will be dismissed and the marriage still subsists. If your wife is already married but not divorced the second marriage is null and void and in that case you could apply for nullity of your marriage.

HELLO,

Now you can file divorce case in which you can bring the matter that your estranged wife had alrady married. In Hindu Law when previous marrage subsists 2nd marriage cannot be conducted. Then the the 2nd marriage deemed as null and void.On that ground you can file for maitenance / compensation. You can also file a complaint in the J.M. Court for appropriate remedy. Both not present in the Court means the marriage was not dissolved. The case might have been dismissed. Hence get all information about the case no and all and contact us then only we can able to guide properly. Otherwise our guidance would be vague.
