How to get divorce and child custody under Special Marriage Act

24-Mar-2023 (In Divorce Law)
Want to file a divorce against my husband after 7 years of marriage due to his insecurity in my job, my promotions and tours in marketing Does not respect me in public , hides both personal and financial issues and on asking gives vague answers. Does not like any family members coming home, does not give money for household expenses, does not talk in house, tells my son that I don't love them which my son conveyed to my parents, before marriage had no religion preference but after marriage his family wanted me to change religion which i opposed and after son birth made him Christian inspite of me saying no and named him without my knowledge . I manage both home and work well Our marriage is special marriage act as I'm Hindu and he is Christian I have a son 6 years old and want him to stay with me . I have no financial dependency on him

Hi
If there is a possibility of him agreeing for divorce then it can be explored and terms and conditions agreed upon ,a Mutual Consent divorce is granted six months after the date of filing ,in the event he is not agreeable then you will have to file one sided divorce Petition on the grounds of Petition. You can contact me for detailed consultation in case you want to go ahead with the divorce.

A petition for divorce on the ground of cruelty, adultery or desertion can be filed under section 27 of the special marriage act. The same by mutual consent can be filed under section 28 of the said act. An order as to the custody, maintenance and education of the minor child could be made under section 38 of the said act.
