How to file for onesided divorce and division of property post divorce

My elder sister want to get divorce from his husband with all the things and the car which is on the name of my sister. But her husband is not give a divorce to my sister. So i want ask that how my sister get divorce from her husband through court and which cases we have to file in court.

Your sister has to file a contested case for divorce, she has to specify why she needs divorce , other way could be you can force your sister husband to compromise with your sister for divorce . Little bit of discussion required for all this. Contact me lawyerhelp for advice

File a divorce petition at the place of your sister stay. You will have to prove the allegations on which you want divorce. There are many conditions and other aspects which are required to discuss before filing divorce. I suggest you to consult a family law lawyer along with your sister.

First of all there has to be a genuine reason for claiming divorce. She can claim divorce by filing a divorce petition under section 13 of the Hindu Marriage Act and can also claim the properties and assets which are in her name. She can also file a case for maintenance /permanent alimony.
