How to file for divorce on grounds of cruelty and desertion by husband

7 months ago my husband sent me to my parents house by saying will come to take you back soon but he never ceases and when I asked he said no need to come back we went to my in-laws house with parchment then they beat me and my husband throw me out of house in beaten condition. What can I do now he is an advocate and I am govt lecturer he threats me that he will trap me in legal issues what should I do?i have 2.5 years old son and working he married by telling fake properties as well..

You first talk with relatives of your husband.what fake story he told .you have right to live in your husband house.in case if you want to know morr you have right to call or mail at my number

Dear, this is not a right time to file divorce case, first you file a criminal complaint of domestic violence directly in the court of your area against all the persons who are responsible to spoil your married life, and explain all the acts of cruelty in that complaint, and after one year of your physical separation you can file a Divorce petition U/S 13 of Hindu marriage act. and you can claim the maintenance for your child from him.

a married woman has a right to reside in the shared household of her husband and her in-laws, section 17 of the domestic violence act provides this right. you can file a FIR against your husband under section 498 of IPC alleging cruelty by your husband and also under the domestic violence act.
