Dear friend as per your question and acording to law you can file divorce petitin before family court groun of cruelty but when you file a petition then after your wife file application u/s 125 crpc for maintenance and domestic violence act also file complaint dowry

Side u r in govt service in probation period so first u or any appropriate person convinced ur wife that she live with u peacefully is beneficiary for both as well as ur issues if not convinced the file case for divorce us 13 b of HMA and be careful from crr cases rest on VI's a vise

There is a solution of every problem in this world. First of all u have to decide what do u want? If u want to live with him we can file case u/S 9 to have conjugal rights. If u want to live separated we can ask for maintenance through court. If u want divorce we can proceed for that. First make up your mind and let me know.

If he is not agree to give you divorce by mutual consent then you may file a divorce petition on the ground of cruelty And you may also claim maintenance allowance from your husband

It is always advisable to go for conciliation involving some elders of the family to save your married life for the sake of little girl.
However, if you still want to get divorce then try to convince your husband to give you divorce and if both of you agrees then go for mutual consent divorce as the same will take hardly 6-7 months. Otherwise you have to file ground based divorce case which will take more time and money.
