How to file divorce against my husband who abuses and harrases me

my maarige completed 15 years & i have 2 daughters elder one is adopated & second one my biological daughter my husband Drink Alchol a lot and everyone in familly knows that my problem is he shows infornt of familly & friends or outer peoples that he loves me lot & take care of me but in alone he beat me sometime & give abuse words always i am totally hareshed with him manytime i try to speek with my inlaw & my mom dad about this issue but no one take my stand becz they think he loves me lot now from past 2-3 years i am in relationship with my friend who always help me to out frm my stress & support me a lot now how can i file a case against my husbad should i have to collect avidence against him & can i get police protection while during case is in court becz i think he will beat me again or can do anything please help me

You problem is related to domestic violence. But you said that you are in relationship with another also. First file a divorce petition on ground of domestic violence and after that you may live with your choice. You may contact me for any legal proceedings.

Dear client, don't worry about misbehave or beating. He can't dare to do so once case is filed against him in court. Only the thing you should dare to do so. But what about your maintenance. R you earning. If so then u may proceed against him only on same grounds. For help u may call me as I am advocate Avdhesh chaudhary looking after many such cases

Hi,
You can file divorce case on the ground of cruelty. Next time when he beats you up, you can call police using 100 or 1090 woman helpline number. However, the best way is to talk and resolve issues by talking. Probably if you talk about divorce, both of you can mutually agree for divorce or work on relationship.
Under DV 2005 Act, you can get protection orders if you fear that he would beat you again.

There are different laws of Divorce for different religion.

For Hindus: (which includes Sikh, Jain, Budh as well) are governed by Hindu Marriage Act, 1955.

For Christians: are governed by Indian Divorce Act- 1869, The Indian Christian Marriage Act, 1872.

For Muslims: are governed by Personnel Law of Divorce, Dissolution of Marriage Act, 1939, The Muslim Women (Protection of Rights on Divorce) Act, 1986.

For Parsis: are governed by Parsi Marriage & Divorce Act-1936. (Under Secular law) Special Marriage Act, 1954.

The Divorce can be obtained by two ways:
 Divorce by Mutual Consent.
 Contested Divorce.
