How to defend a false 498A case

15-Feb-2023 (In Divorce Law)
Since I don't have divorce decree, my 2nd wife has filed for null n void (she has divorce decree from court). Hence I've applied for declaration of divorce from previous wife and got the same from Ahmedabad court. Now my 2nd wife is withdrawing her null n void case and is planning to file divorce + 498 case against me. What should I do ? ( to get her back ). She is in Mumbai and I am at Ahmedabad

As the situation is a bit hazy as you have not provided with the proper details. However, if you have married your second wife without giving divorce to your first wife then the marriage with your second wife stands null and void and an offence of bigamy u/s 494 of IPC, 1860.

If you want to legally marry the second wife of yours then for that purpose you will have to divorce your first wife and then, marry your 2nd wife. Also, the case u/s 498 of IPC, will be tried by a competent court and hence you will have to attend the proceedings for the same.
