How to deal with false claims of harassment filed by wife

my wife has filed a section 7(1)(c) of family court act against me and my family stating that we have harassed her and took her parental share which is a false claim. i live in oman and she lives in kerala from last 4 years we are married but have lived together for 1 year only and that too in parts. Now she and her family claims that they have given 10 lakh Rs. as parental share to my father and 5 lakh to me but both the claims are false. they gave 10 lakhs but to their daughter as fixed deposit in bank and i was joined to that account after marriage, and after few months of marriage i gave full authorization to withdraw the money and she shifted it into her new fixed account. now she is asking share in the property which is in my mothers name and has also filed a harassment case in my fathers and mothers name, but she haven't lived with them more than 10 days.and also she has filed a divorce stating that i have forced her which is false i have proof against that. what should i do.

Hai.

The said section reveals that she lodged a mony claim against you alleging on patrimony, ie watever her money that came to ur family. Or loke share of her family property given as dowry. Thats wat going in society.

Now the only thing remaining for you to do is to contest the case by appointing a lawyer. Since the case is for money despite for your personal presence for mediation talks, case can be conducted through power of attorney. U dont have to come down from abroad for each postings.

Regarding case u have to prove that the money she claiming isnt her's. Tats all. There may come a conditional attachment also against you. Tats managable though.

Do find your lawyer and contest the case.

If those allegations againat you are baseless..you dont worry about it. If your wife filed case for divorce definitely you will get the summons from the family court.Unless she proves the allegations on claims it willnot be sustainable

jst find your lawyer n proceed with it. Two things for divorce case u have to come down in person and for the other one there is no need for ur personal presence.
its time to meet you lawyer and to file objection and contest the case properly.

Your wife had filed a petition for return of money. But please understand that, you must prove that you had not took any amounts from her. you may collect the details of bank transaction from the concerned bank if possible.
Any way you have to defend the case with the help of a Family court lawyer, tell the details to him and request him to file a petition to call for the documents regarding the deposit made and your letter of authorisation to withdraw the amounts from the bank and her withdrawal of amounts by your wife and her deposit in her account. the concerned bank manager has to be citied as a witness and examined and proved this facts in court. Once this case is proved the harassment case against your father and mother will loose the balance. So be careful and consult a good family court lawyer and he can certainly help you in these lines.
