How much amount can I claim for maintenance

Actually from d last few months my husband was into extra marital affair.. we daily face arguments and he beaten me twice and he was in jail for 40 hours.. now my father in law and husband banned my entry to my house.. father in law has registered the case of restrain and husband is demanding divorce.. he is also not living with father in law... he doesnt have any propertt or savings... i want to know that how much approx amount i can get as almony or i should take the maintenance on monthly basis??

Your can get monthly alimony according to your husband's monthly income from various sources..
It is not necessary that you will get alimony only from salary or other monthly income. You can count the monthly rent if he is getting or any other work side by side of her is doing

If the situation is as such then you have every right to claim maintenance from your husband. For this further you have to file case before the family court and the court will decide the amount of maintenance. It depends upon the earning capacity of your husband. For this purpose you have to show your husband salary slip and other documents which show how much your husband is earning. So as of now I can only say that consult with the lawyer and take step accordingly. Best of luck

Usually the maintenance is 1/3 rd of Husband's monthly salary. But in your case since your husband has no property in his name and no job for earning we need to build a case after looking into many other details of your husband. Then only we can finalise whether monthly maintenance or wholesome settlement is better.

Hi, you will get the amount as decided by the court in the financial circumstances of you and your husband. You will, be also given shelter. You are required to file the case in the appropriate court.
