How get divorce and custody of 5 years old child

Hello sir /madam i am  staying in Bangalore want a legal advice regarding my Divorce . i have kid of 5 years my husband is a mechanic we had a love marriage but things are not looking good in both of us life so i would like to know some advice...

Madam in this case you can file a case of divorce in bangalore on ground of cruelty and further you can file a case of maintenance for your self and your child, and if husband is ready to give divorce and pay permanent alimony and maintenance to your child then you both can go for mutual consent divorce.

Are you also working ? and have you discussed the matter of divorce with your husband and is he willing for it ?
If your husband does not object to giving custody of child to you, it is easy. Otherwise, you have to make good ground for it.

You can file a divorce case and seek for maintenance also for you as well as to your child.

Dear Madam,
As per your query, you can get mutual divorce if your husband is ready for the same or you alone can file case for divorce before Family court but you have to give valid reason to obtain decree of divorce.

In your case you informed that you are not interested to continue with the relationship and also sought for divorce. Here in case if you want you go for divorce by filing divorce case under Mutual Consent. Before that you should ask him whether her is ready to continue or not. in case if he is also willing for separation then you can go by mutual consent. In case if you not, you need to file the case under different head by giving specific reason.
