How can i separate without loss of marital property and maintenance?

Hello sir I want to tk separation fron my husband bt don't want to leave this house..for parenting of our children. .I hav two kids 1 girl n little boy..after 11years of marriage I want to live separate wd my freedom n identity. .don't want to interference of my husband in my any matter. .because his very aggressive .egoistic n short temper nature.. just I only want his name n financial support for my children. . we can live under same roof without hurting any one physical n mentally. . is it possible. ? pls suggest me as soon as possible.

As far as living under the same roof and yet separately from your husband is concerned, the same would depend on the exact circumstances of your house and the prevailing conditions. Legally you can definitely stay in the same house and claim expenses for your children as well for yourself.

आप जैसा चाहती है, वह बिल्कुल संभव है।उसके लिए आप चाहें तो अपने पति के विरुद्ध "घरेलू हिंसा" का केस दायर कर सकतीं हैं। इसमें आपको वह सभी रिलीफ मिल सकते हैं, जो आप चाहतीं हैं ।
दूसरा यदि आपका विवाह हिन्दू रीति-रिवाजों से हुआ है तो आप "हिन्दू विवाह अधिनियम" की धारा-10के अन्तर्गत "न्यायिक अलगाव" के लिए केस दायर कर सकतीं है।

Hi,
It is possible only through talks and proper mediation and counselling. If you reside in Delhi, you can contact High Court Delhi Mediation Centre. However you must meet a lawyer for the same. It is a sensitive issue and as you stated your husband is aggressive and egoistic, so be very careful with your talks.

Dear sir/Mam,
we have readout your query very carefully, you want to take speration from your husband and donot want to leave this house , mam if you have leave with any interference and without any physical hurting and mentally, one of the solution in this problem , you can talk each other for a mutually understanding, and u can take your share your husband.
