How can I file for divorce and child custody

Hello, I am a 32 yrs old Hindu female,married since 5yrs and have a 2yrs old son. Due to constant emotional torture by husband and in laws and futile discussions to save marriage,I am planning for filing divorce .I do not wish to claim any maintenance for myself and neither for my son. I just want divorce without giving access of child ( The husband directly and indirectly many times showed disinterest in child and never gave me a rupee for myself or for son all the past yrs from marriage.) Can I claim such way? Is it a legal compulsion to give access even if husband not giving maintenance?

hi
you can proceed before the family court by filing application for dissolution of marriage.
since the custody of child is concerned it will remain with you as per law.
as far as the access is concerned we need to negotiate the terms before the court for access and put limits upon it.

Dear client u can file divorce on the ground of cruelty or any other grounds as per yr case. As yr son is not five years age so custody remain with u. Also if u wish u can ask maintenance for u and son by filing maintenance case under sec 125. For proper discussion call me

first let me know how you got married, arrange or love? if arranged , through whom it was arranged? we can take the help that person in pursuading your hausband to leave the right to access. otherwise you can take helkp common friends for settling the terms for mutual divorce very well .
