How can I avoid false domestic violence case to be filed against me

28-Jan-2023 (In Divorce Law)

I would like to divorce with my wife. But, I am pretty sure the moment I ask divorce under mutual consent, my wife's family will file for domestic violence just to get more money. Is there any way out of this? Last year only she and her mother blackmailed me that I if I do not listen to them, they will file a case of domestic violence. The only bad habit I have I drink twice in a week and I never even scold her or harrass her. All I want is to have a peaceful life where she lower her expectations, she lives her life and I live mine. But, she wont. How can I avoid domestic violence suit?

At this point of time, you have to decide that whether you want to continue with your marriage or not.  If you want you can file a divorce petition under provided section of the relevant act. False cases are false but they can be very well filed to harass you.
In such a scenario it is suggested that you must start preparing for series of false cases against you, you should start collecting documents proving her work experience salary statements etc and also if needed give a compliant to your regional police station mentioning that your wife is threatening you to file false cases. Do this only when you are sure she is going ahaead with any false complaints. For more details or suggestions please feel free to contact experts at Lawrato
