Hindu wife ran away to USA and filing a false case what to do

Dear client you will file a case against her here i.e., in India for reunion. You will issue notices to her through embassy. You write to visa authorities that she cheated or left you without your permission and pursuing further studies. Without your consent she went out of India. Your GF pictures etc., may not be taken into consideration by the court unless there is strong evidence according to Indian Evidence Act and Information Technology Act. You first issue notices to her and file a case in family court for reunion and convey the same to her through embassy.

We are married for 2+yrs, and stayed in USA for 9 months after marriage. Together we came back to India around 2yrs back. My wife left my home and moved to USA on F1-Visa(Student Visa) When we tried to approach a Lawyer and court filing a case: asking her to come join my family. They filed a case aganist me asing the court to decline my case based on following evidance/grounds. She had some of my GF pitures, prewedding relationships. One last phone conversation, in which she made me talk little aggrisive. I paid for her IELTS (English-language skill exam, which is useful for USA, AUS and other conrouries for college entrance) and she holds one document that I filled for my Visa, but thats company sponsered. Based on these two she is climing that, I sent her on F1-Visa and I was about to go to USA on work visa. but I dont showedup there, instead filed a case here in India. I dont know if court belives this? basic question:is she simply waiting there for me from 1+yr?

Hi
It appears that your wife is trying to prove the following
a) That you are in an adulterous relationship and hence you have committed adultery and
b) That you are aware of your being issued F-1 Visa and hence she has not deserted you and
c) Inspite of you having work visa, you are refusing to travel to USA, for reasons that suits you (adultery, not wanting to resume marital life etc).
So technically she is putting you on defensive and denying you any grounds that you might have filed for RCR/ divorce.
So you need to plan to position your points of view/ evidences in such a manner that inspite of you having a work visa you are unable to travel to USA and shift the blame on your wife's mistakes (rather than defending her claims)
