Hi,

do you also love her and you want to marry her? if so file a divorce petition and also lodged a police complaint. you can also seek police protection but first divorce petition must be filed after this you can seek.

In Hindu law she can marry you only if she divorce you.If she is willing to divorce then you can tell her to file the petition for divorce, and then you are free to marry after 90 day of her obtaining decree of divorce.

Sir, what you do with you personal life is your prerogative. I cannot guide you in that regard. Having said that, a husband of a married woman does have the right to file a case of adultery against you and the case would proceed in court as per the usual time. If the wife has been abused by the husband, she has the right to file proceedings under the Domestic Violence Act as well as other sections of the Indian Penal Code. Her support for you does not mean the husband cannot proceed against you. Under the conditions you have outlined, she may also proceed for divorce but the facts has to be analysed in detail. If you feel that the husband is trying to harm you physically, you should file a case diary/FIR against him. It would be prudent if you and your lady friend are not seen together. For complete and better analysis, you and your lady friend will have to consult a lawyer in person.
