gifting our house under EMI to wife

I m Anurag, from kolkata, married in 2011..We both want divorce.. 1. Our house is under my and my wife's name, it's 17lakh is due in form of EMI which is right now paid by my wife's salary..Can I gift her this house which is under EMI of SBI. 2.other main thing is that , if unfortunately something happens to my wife, will I be responsible to pay the remaining tax( I will not be owner of house as I hv gifted to her at time of divorce). Kindly reply me.. Thanks
You can give divorce to your wife there is no bar but regarding rest of your quirky you should approach the bank for transferring the property in the name of your wife that will be effective only on the consent of the bank as the flat was purchased under the hire purchase agreement.
