Gf delivered my baby in Germany am I liable to sign birth certificate

Dear Sir, I am from India and my Ex Girlfriend is German. We broke up last year and the very next month she told me that she is Pregnant. I didn't wanted a child but she went against my decision,saying that she will take care of the baby herself and she delivered a baby girl. Now she is demanding that i should pay for the Child care or else she will report to the German Embassy in India.losing my Job will affect my family as i am supporting the mother who is diagnosed with Cancer. I don't want to sign the birth certificate or go for a paternity test. How can it affect me in India?n

You have not married with her and legally and biologically you are the father of the child. So it is your legal duty to provide maintenance to her. If she came to India and file a case of Rape against you then you will come in problem or if she report to ambassy that after cheating on her you ran away from there.

Hi,
You are the better judge of your position. But, legally you are are expected to pay for the child care. I am not demorlising you, but reminding of false women oriented case and effect of their misuse. Being a govt servant, it is better you solve the case early.

With your words we could presume that you two were living in a live-in relationship and as adults you knew the consequences of intercourse i.e she becoming pregnant and giving birth to a child hence you are the father of that baby girl. The courts in India consider children born out of live-in relationship as legitimate children and by that you are liable to maintain your baby girl.

Further, your girl friend may begin a litigation for maintenance in the Indian court through the German Embassy in india and you are bound by that. Incase if she institutes any Petition for Maintenance you have no other option that to contest it and as per the Indian Court 1/3 rd of your official salary may be granted as maintenance for your child.

you may resist for paternity test but if the court insists you to undergo then you have no choice than to undergo and your parental status will be then confirmed. so either you contest the case if she files anything. otherwise you can talk to her and know what is really going on in her mind and if things work out you can officially marry her and get settled down in Germany and have a better life if you both have compatibility. Because after all always litigation alone can never solve all problems and in such matters i would always suggest my clients to settle the matter through sincere conversation and counselling. who knows you may have a beautiful life ahead in Germany.
