Filed for divorce on grounds of adultery, can her bf be made party

I have filed divorce petition against my wife on cruelty n adultery. Can the person whose against i have audio clips proving love affairs for my wife , be made party to the case.

Yes ofcourse we can make your wife's Boyfriend party to the case in divorce.
In fact we have a similar case pending before Hon'ble Court where the boyfriend is a party to a suit for divorce filed by husband.

No you cannot make that person a party to divorce petition. But you can file a complaint against that person and he will be booked under section 497 Indian Penal Code. But in order to book a person under section 497 IPC the complaint should prima facie show that a person, other than the husband, has sexual intercourse with the woman/wife and he had the knowledge that the woman is wife of somebody else. Yes other man can be made party to the case in case of adultery and this can be ground for claiming divorce. If you have audio clip to prove affairs then this audio clip can be used as evidence for divorce proceedings. Since there is possibility that your wife might also be seeking legal help; she can also rope you in frivolous court cases.

yes you can make the other person party in your case. for this you need to move an specific application in the court for the admission of a new party in your case. the evidence will be given by the party in the court in your favour. but if you have specific proof against your wife then you need not to make other person as a party.
