Father threatening to file false case against my mother and brother

My father is abusing my mother everyday by saying that she is a call girl and run a sex racket .whenever she goes to relatives wedding or to meet them . He always shout on her that she would have met her boyfriend .Not only this last week my mother went to Temple and when came he said I know where u have gone . He Sometimes says to me that I m not his Blood . I am having one younger brother . And my father always say him that her mom is not what he thinks .she is very clever lady and he said soon i will file a case of foul play .Says to my brother soon i will take revenge from your bro and mom

Why at all your father is behaving like that .first you should try to know as far as legal advice is concerned you may file many cases against him because he can't behave like this. It is an offence. Moreover your mother can seek divorce on this ground but more important is what you want .then only coarse of legal remedy is advised. So please think about it. If you want to stop ur father from such behavior then file a police complain. So decide the you want then come back.

This is a complex issue with no easy legal answer. Whereas she could start a domestic violence case against your father you must ensure that she has the money to stay separately with your and your brother. Actually getting him to pay maintenance can be quite difficult despite court proceedings. Any lawyer will have to proceed delicately. You want to make a police diary just to ensure that this information is recorded somewhere. You will need to consult a lawyer in person who will ask you the relevant questions and then you guide you. Your mother may also seek a divorce or mutual separation on the ground of cruelty.

your mother can file a case against your father under section 12 of Domestic violence Act. Also file complaint to the concerned police station regarding threatening, abusing any kinds of torture to SHO, DCP. Also meet to Women Commission.
