Father cheating on mom, how to ensure her security and save our money

23-Mar-2023 (In Divorce Law)
My mother is 60yrs old and my father is 61yrs. Recenty it has been found that he is cheating on her with a younger woman. He has been the gurantor for a housing loan for the other woman and has been paying the money with drafts. He doesn't accept this and on questioning he beats my mother and threatens to kill. All major payments of the household is done by my mother. Both of then have saved under joint account. My questions are - 1. What can be done to prove him guilty /accept his misdoings? 2. What things to consider if my mother wants to go for a divorce? 3. How to ensure /enforce he doesn't beat my mother? 4. How to stop him from paying the money for the loan? Request you to answer at forum or by email ONLY. We will get in touch ourselves. Please do not call.

First you must file a domestic violence case against your father, wherein seeking for protection order from the court as well as you would get interim maintenance as well as file a maintenanace case against your father, i.e. section 125 CRPC claiming for interim maintenance, moreover, if you need to file divorce, you need to prove that that your father is having an ilicit relation with another female, which is adultery and it is good ground for divorce, inform the court through all this as well as file a General Diary before the local police station.

Hello,

First, your mother should lodge an FIR in the local police station. Try to record his conversation. Divorce can be filed on the ground of mental cruelty. Everything can not be discussed here and need to know the detailed fact of the case.

At first your mother can send a letter to the branch of the bank specifying the details of the joint account and request them not to procced with any kind of transaction further in the said account until further letter.
Your mother can seek help by filing a petition before the protection officer of your district under domestic violation act.

First is to stop the payment from joint Bank Account, either to withdraw the amount or any other means. Secondly, if he beat his wife, then wife can lodged a written Complaint against him before the Police Station. If your Mother and Father joinly resides in a joint mess, Then only your mother can file Divorce on the ground of Cruelty, provided that, she can lodged 498(A) IPC as I say earlier.
