Sir meri shadi 2012 me hui thi shadi ke bad meri patni sirf 3 din mere ghar par rahi ham dono ke bich physical relation nahi bana wo mere sath rahna nahi chahti thi Bad me pata chala ki wo is shadi se khush nahi hai. wo kisi dusre larke se shadi karna chahti thi isliye mere sath rahna nahi chahti hai. majbur hokar maine 2014 me divorce kesh file kiya tab jakar larki ke pariwar wale mere ghar par aaye aur bole ki meri larki apke ghar me nahi rahegi tab panchayat level par baithak kar punchnama banaye aur court me affidavit ke madyam se likha ki maine sara saman wapas le liya hai aur bola ki aap larka ka shadi kar le hame koi dikkat nahi hai aur wo shadi me di hui sara saman lekar chale gaye lekin 2 din ke bad larki walon me mere aur family member ke upar jhutha 498a ka kesh kar diya jisme police paisa lekar kesh ko true kar diya hai chargesheet and cognizance bhi ho gaya hai. mera divorce ka kesh abhi chal raha hai. sir aap muje bataye ki kya muje 498a ke kesh me rahat mil sakti hai.
As per the fact of the case police case is aftermath creation because of filing of the divorce case, then You can file quashing against the order of cognizance before the Hon'ble High Court or get it full and final settlement by the other party through mutual consent.
