Domestic violence case against husband and in-laws

I have filed a domestic violence case against husband and in-laws for physical, mental and financial harassment. I have claimed for residence and maintenance relief in my DV application. I want to know if I will be eligible for maintenance from my husband with the fact that I am earning more than him.

Dear client it is duty of yr husband to bring before court that u r earing more than him. Generally working women's r not entitled for maintenance. But yr husband have to prove that u r working and earning. For any legal help call me

I have gone through your query, to be honest it will purely depend on the judge as how he will consider your case. And if we o technically you will not be entitled for any claim as your earning more than him. Alimony and maintenance is machinery which is provided to a person who is not earning who who is having no source of income to fulfill their livelihood. So in your case it will be very rare chance to get maintenance.

dear client,under PWDV act you should be in a domestic relationship with non applicant.The court will grant you maintenance after considering living standard of both the parties.therefore even if income is more than your husband you are eligible to claim maintenance,if he is having property and a luxirious living standard.
