Divorce without mutual consent when marriage has not completed 1 year

Dear sir/madam, I had love married to a girl with whom I was in relation for 2 year. When we were in relation she agreed to live with my family and behaving good. After marriage she changed her behavior and now pressurise me to live my parents. Her family to support and pressurise me. Please sir let me know what to do. Date of marriage april2016. I know I can't divorce her before April 2017 but I want to know how will be my case when I file for divorce

Dear Querist,

One can file for divorce within one year of marriage on the grounds of exceptional hardship and special permission of the Court has to be sought to file for divorce. Advisable to wait for a year from the date of your marriage, do take some time to make best efforts to reconciliate your relationship with your wife, if possible seek the help of Marriage Counselor. It may be difficult but definately not impossible to address your wife's concern by identifying simple solutions amenable to both your wife and parents such as availing her some privacy or personal space in matrimonial home, being more sensitive to other expectations etc.

If you still are unable to reconcile then you may consider filing for divorce on the grounds of cruelty or mental torture however this should be your last resort and consider this option only after giving your best efforts to save your marriage.

You are not able to apply for divorce petition within a year. But if you are going apply with mutual-consent (both should be agree on this). You will get divorce in six months. If you are going on apply alone without her consent, it will take time.
