Divorce to wife without giving any anomaly

04-May-2023 (In Divorce Law)
I had got married on 29 Jan 16 as per Hipndu Tradition. It was an arrange marriage. My wife was a Govt PET (physical education Teacher) teacher. But we were unknown that she had produced a forgy document to the Education deptt & in Nov 16 she had got a notice from the education deptt to justify abouro her CPED cert (central physical education depth). But she could not justify. So she gave the dischrge appliction. On 06 Dec 16 she attempted suicide by hanging herself in her parental house. She was admitted in pvt clinic & got the life. Now I want divorce her without giving any anomaly/ any maintenance chrges. Because they had not told me about her forgy document before marriage. My question is - Can I lodge a divorce petition on the basis of her forgy documents?

Your wife's job can not be a condition of your marriage. Your wife's forfeiting her job due to some reasons can not be termed as a forgery against you. By doing so, rather you will land into trouble, in such case your wife will drag you into the court of law. Considering the nature of your wife's case, it is suggested that give your wife a chance to live a better life, you can add value to her life at this juncture. If at all you do not want to continue with her, you can file divorce suit , however on other grounds, which you have to prove. In your's case court may allow alimony in favour of your wife considering her present status. What about your date of marriage, any child born out of your wedlock?

Dear Sir, is that the only reason, you want to divorce her ?
I don't understand why ? You can file a divorce petition, but I don't think it will be without alimony.
Talk to her and try to settle things and differences.

Yes, if the consent from you for the marriage has been obtained on suppressing some material facts, or fraudulently by some means, you can file for annulment of marriage whereby your marriage would be rendered void an initio i,e, the marriage would be deemed to be not recognized in the eyes of law. However, the limitation to file a petition for annulment of marriage is within one year from the date on which you discovered the fraud. It is different from Divorce.
