Divorce needed without mutual consent from husband after 10 yrs

It's been a month that m staying with my parents... it's been 10 years of marriage... how much tenure is required for a divorce automatically as my husband is not giving me divorce ... he is a big piece of shit and I can't stand him anymore .... highly irresponsible person.. hv two kids ... one with each.. 6yrs boy with him and 3 yrs boy with me... I don't earn... but I need a divorce desperately... he is getting on my nervous by telling me constantly that he won't gv me divorce and wants to screw my life like this

You can file a petition in the family court for divorce on the grounds of incompatibility. You will have to contest your divorce as your husband is not ready to divorce you. Also that no such tenure is stipulated for divorce

It is misconception that automatic divorce happen.

In your own words you stepped upon shit and after ten years you realised that the shit has made your life shit.
Do not worry .it appear that your relation is not working out and due to which you have stress and disappointment frustration.
Accidents happen always because of others we take precautions but that is accident .you can get divorce but you need to talk to me with various event after marriage which are grounds for divorce.

dear client,as per section 13 of Hindu Marriage Act you get the divorce from a cruel husband, as you mentioned the period of 10 years you are living with your parents, from the school certificate of your children you can show to family court about the facts, where you can decree of divorce,
