Did not live with husband after marriage, is divorce necessary for us

Hii i and my husband got married as per hindu act we just have the form filled in madir n tht donation receipt.we havent stayed together after marriage and now we want to start a new life with someone else.is notary and hadwrriten document a safe option?

As per Hindu marriage act saptpadi is essential, in your
case except writing on donation slip no other proofs
with you if both are willfully changing your decision
then as per my opinion make an affidavit on 100rs
for both each other in two copies for each with
2/3 friends as witnesses that is the sufficient proof.
but don't spoil future of each other by this minor mistake.

if you married as per Hindu ceremony, rite, custom
if anyone of you claim that another is legally wedded spouse
then you must go for divorce in court
otherwise it won't be safer in future, not advisable
Reason for not cohabiting not specified, there may be better solution, if you share more details

No, if you have married as per hindu rites and rituals then you have to take legal divorce from court, notary and handwritten document is not proper and no value in the eyes of law, only you can start your new life after getting Divorce from the proper court
