Daughter in law left my son how can he claim for divorce

My daughter In law prior to marrying my son in October 2012, was in love and affair with other boy and the took the issue up to pregnancy and abortion which we came to know only on Feb 17th 2013. After that she fled to her parents house and they orgonized and sent local Goondas and rowdiness to threaten us. There after my only son went to court seeking return of his wife on May 12th 2013 and decided to stay away from us as per the wish of his wife and his in laws. Again after 6 months she deserted him on 19th Oct 2013 and never returned till date. My son feels to have divorce now please advise

File for judicial separation under the ground, irretrievable breakdown of marriage. After one year, you can file for divorce and claim maintenance from her .

This is becoming complicated for you , it's better you opt for a remedy at early stage or would become difficult to handle legally , if ur daughter in laws intention is not to stay she cannot be forced into but yet you can also seek alternate remedy legally ,hence better act swiftly and with proper legal advice , you may contact us early as possible . If local goondas threatened you why did you not give a Police Complaint? If your son has already approached the Court for Restitution of Conjugal rights against his wife and appears to have lived with her.And now you state that she has desrted him and since six months is not staying with him, claiming that she has deserted him, what happens to the decree for grant of conjugal rights? If your son has to file a case for desertion then he has to wait for another one and half years before he can approach competent Court for grant of divorce on the ground of desertion.
