Contested Divorce with wife. Used me for only money earning

I want to take divorce from my wife who used me only as money earning person.she never had love for me.she slept with me only when she wanted kids in 8yrs of marriage.after 2kids & 8yrs of marriage,I have found love in another girl.now I want to marry her & live my life happily at least now.I want divorce but my wife threatened me that what ever I try,she will not give divorce.she claims that Indian law will always support only female & will not believe what so ever I say against her & whether I like it or not,I have to live with her & take care of her & kids.have been givin 30k for her expenses. What procedure?

You can file divorce petition before family court n the ground of cruelty and desertation but you should pay the maintenance, if you want get divorce from her you has to prove that she is given mental torture you and given sufficient opportunity to mend her opportunity but she has changed

File a case for divorce on ground of mental cruelty and get divorce, further if you are able to prove cruelty the court will give to divorce, mental cruelty can be proved by direct or circumstantial evidence.

If you two have been living separately for a year now, you may file for divorce. Living separately does not necessarily mean under different roofs, it means if you are not living like husband and wife.

I would say you have a discussion with your wife and opt for divorce with mutual consent as it is the best form of divorce as it takes 6 months to take divorce under this procedure once the papers are submitted.

However, if one of you choose to contest the divorce, then it would cost you years of litigation. In such a case you will have to file a divorce petition and prove your ground for divorce and your wife will have to produce evidence to disprove the allegations made by you.

Best way forward for you now is to convince your wife to take divorce with mutual consent.
