Contested Divorce. Please help us to proceed ?

My brother's wife is at her parents home for last 2 years. My brother needs Divorce from her. But she is demanding huge amount to accept for divorce. They don't have any children. They got married in 2012. We are from lower middle class can't reach her demands. Please advise to get divorce.

2 years of separation is by itself good grounds for divorce. File a petition for restitution of conjugal rights. since the lady is not willing to lead a marital life , she will by default violate the Restitution order. So your brother will automatically get divorce since your brother's wife will default in complying with restitution order

Hello,

Ask your brother to file a divorce petition under desertion ground before the family court under which jurisdiction they both have last resided together. No need to bend to their demands. Let her contest the case and you fight it out strongly. All the best.
