Catholic married with Sikh girl in Gurudwara can I file annulment?

Sikh girl got married with Catholic boy in her domicile in a gurudwara. There is no certificate and marriage was not registered. Got separated within 6 months of marriage in Mumbai. DOM - 23 Dec 2008. Have proof of residence shared with another girl on rent, as staying separately from 2009 onwards. Have not applied for divorce or annulment as the boy is not traceable. Do not have permanent address details or number of the boy as it was a quick love marriage. Girl wants to get married again in 2016. What steps to follow? 7 years separation is considered annulled, I am told.

Dear client only court has power to grant divorce. So living separately for many years does not dissolve marriage. U have to apply for divorce in court on desertion of marriage. If boy will not come to court then court will give u ex party divorce. To file divorce registration of marriage is not necessary. Yr photos of marriage will establish yr marriage. an order of annulment has to be passed by the appropriate court. There is no such thing as deemed annulment. A proper recourse through appropriate legal processes has to be followed to nullify/dissolve the present marriage which is still subsisting in the eyes of the law, in order to enter into a re-marriage. you may contact me for further legal consultation and processes.

Engage a advocate and give public notice in newspapers thru him for tracing the boy. Thereafter you can file a petition for annulment of the marriage, but some proofs like marriage photographs are required for filing petition in court.
