Can we amend terms and condition under MOU once filed?

After mediation sessions parties filed for mutual divorce and MOU has been signed by both the parties. But I want to ask that if we want to amend the terms and conditions un MOU now can be amend it. First motion date is on 18th Jan. Are we allowed to amend it?

If the other party does not have any objection then in that case you may amend the mutual consent agreement . There is no bar in renovation of a contract all ready executed. or you can suggest/put your fresh terms/conditions before the Ld. Presiding officer in the proceedings of first motion itself for consideration by court.

In such a situation it is to be seen whether both the parties agree to the amended position or not. If both the parties are looking forward for the amendment then we can move an application before the court and the matter can be again referred for mediation or the court itself can allow for incorporation of amendments.

There is no problem you may change the terms & conditions mutually. If date for 1st motion is 18jan you both may amend conditions mutually and may file amended first motion petition . but mind you that this could be mutually only
