Can i live in matrimonial home if my husband is cheating on me

I m a married girl having 6yr kid.I m not divorcee my husband leave me.I start the case of 498which is stay by high court,125,and domestic violence r moving .my husband cheats me during marriage he was already married with someone and leave that lady by fatwa and me too.So he is a cheater I had a documental proof now he wants to cheat another lady .So can I live in my matrimonial house.He is already engaged in extramarital affairs.
It entirely depends upon you whether you want to live with him or in the matrimonial or not . Since as per the facts given by you its clear that the person who you are married to is an habitual offender and is not satisfied with you . It becomes important that in such situation when all the possibilities of reconciliation has ended abruptly , you move on and press for the maintenance on these ground and also file a divorce by asking huge compensation.

Yes you have the right to reside in the same property or in the alternative he has to provide you with alternate accommodation which is a statutory right. So you can approach the appropriate court seekinng the same.

Dear Greetings, you are entitled for maintenance which you will get under section 125 CrPC. No one can ask you leave house forcefully as your husband has not given you a valid divorce (talaq) and if he is cheating other lady also, produce that proof in the court and tell about the conduct and his false information given by him to you at the time of marriage (Nikah). You should leave only after the valid order from the court of law. Your basic rights cannot be taken away. You will get maintenance for you and your small kid.
