Can I get alimony if I am educated but not earning

my husband works on foreign vessels and earns more than 2000 USD per month. I am a christian and have a son from this marriage. he abandoned us both for last 5 years as i caught him multiple times having affairs onboard and here in india. It has been more than 2.5 years since I have filed for maintenance under PWD and DV. However, I have still not got interim maintenance for me and my son (11 years). though i am educated, he told me be a housewife after marriage and now his lawyer argues that i am purposely not working even being educated. please advise

As per your query, since you are educated the court might not grant you maintenance as you are capable for working and bearing your own expenses according to the recent Supreme Court judgement. But you can plead the court that you have to take care of your son and it is difficult for you to manage both the upbringing of your son and job together.
Also, you can ask the court to grant maintenance for your child as it is a father’s responsibility and he is liable to provide for his children and bear their expenses.
