Can I file for conjugal rights if wife's parents forced her out

25-Mar-2023 (In Divorce Law)

I am Maharashtrian Guy and I Got married to Gujrati Girl on 8.01.2016 .After marriage we indulged in physical relationship only once .But when her parents came to know about our marriage they convinced the girl to break the marriage by putting pressure on her and saying that they will kill me if she stays with me .I have all the proofs like Letters ,SMS ,Phone recording which indicates that girl was pressurized to break this marriage .Should I file a Conjugal Rights case ?Even after knowing that girl will not talk in my favour in court ?What if they file a false DV or rape case against me ?

Without perusing the papers and documents it would be difficult to advise. However from the gist provided by you, yes you can file case for conjugal rights. Also you can file a complaint with the local police station before they lodge any complaint

Dear client u can file restitution of conjugal rights case under sec 9 of Hindu marriage act. These proofs help u to prove yr case. If they file false dv or any complaint u can expose them with these proofs and those false complaints will not survive. For any legal help call me

I think when you got married with consent, you are major. In this case you in laws cannot forcibly take away your wife from you. If it is done you can lodge report against your in-laws at Police station and also can file writ of Hebeaus Corpus at High court instead of conjugal rights. Petition for conjugal rights is filed if wife on her has left her marital house.
