Can I file divorce on the ground of emotional abuse

Hello sir, I am a female married to an it professional from almost 7 years. From the beginning he used to control me. He doesn't allow me to freely visit my parents or make a call to them. He does not say anything directly but does it through action. If suppose I did anything he dint like he would insult me in many ways. I have stopped doing many things just to make him happy. In the huz everything is decided by him, even the smallest of deciding where to buy veggies will be decided by him. I have no say in it whatsoever. He use to insult my parents a lot saying that they dint give due respect to him as a son in law. There had been so many problems in my house, because of which I have health issues also. I have two kids. Though I can't explain everything here, everyday living with him is like walking on egg shells. How much ever I do, he will have something to complain. He will insult me saying that I am not worth doing any work properly. He also insults saying that I don't earn,

Hello Madam, I can understand the sitauctions. I hope you would have considered all those things would happen in future and also considered about your childrens future. If you feel that you cannot live peacefully or lead a peaceful life, you may approach the family court for divorce on the ground of cruelty. At the same time you may seek maintenance from your husband's 1/3 salary or his income to lead your and children life. He is liable to maintain you evenafter the divorce. You can file case on the ground of cruelty because whatever the information mentioned all are cruelty. Hiddenly he tortured you mentally it makes your health and wealth. So divorce can be filed on mental torture

Mental cruelty by verbal means and the conduct is also a ground for divorce. There are caselaws which classify certain action as mental cruelty and it is always decided based upon the facts of the case. If you give more details we could find whether it could be classified as legal cruelty and whether you could file divorce case.

If you think that you no longer want to tolerate his mental & emotional abuse, you can file a Petition for divorce on the ground of mental cruelty. You will have to explain in detail some of the incidents and instances so that the Court will be able to come to a conclusion that you have been subjected to mental cruelty and emotional abuse that that you are no longer able to tolerate it. Kindly discuss in detail and file a petition for divorce as soon as possible. You can surely succeed. I can give you detailed advice if we can discuss this.

Sure , you can file . Before filing you should keep in mind that the life has always high as well as deep. Its better to you both should took a mediation as earlier. Mediation will solve many of the queries related matrimonial issus. Filing a petition is not a solution for the matrimonial issues. It was a virus in the society .it should be controlled by alternative solutions.

So far it's better to took mediation as earlier .
