Can I claim for visitation rights for my child

15-Apr-2023 (In Divorce Law)

1) Me and my wife are planning to file a mutual divorce petition. We have a girl child of 1.5 years. 2) wife has asked for full custody and visitation right is once in 10 days. 3) Is it ok that for the sake of getting a divorce I agree to this in the initial agreement and later file for a proper custody and visitation rights? As I am more interested to have a joint parenting system which is now being recognized in india and also is in the best interest of the child. 4) me and my wifes family live within walking distance, will this proximity get me more visitation rights?

Hi,
Yes. It is ok to sign now. But courts will be reluctant to change the visitation rights unless considerable change in circumstances exist. So the best option would be to negotiate now. However since both of you live in same street, hopefully with your love and affection you can win over the child and create an environment of considerable change
