Can I claim back expenses of marriage in case of divorce

Wanted to understand if we go for mutual consent divorce is there a law which states that whatever we had spent on marriage( gifts, expenses etc) can be claimed back or does it depend on what husband agrees to return after divorce...what all is a women entitled to get after mutual divorce

In case of divorce by mutual consent details such as money spent on marriage, gifts, expenses etc depends on what is agreed between the parties and submitted before court. There is no specific law regarding the exact entitlement of women in case of mutual consent. Generally in divorce proceedings wife is entitled to such maintenance that she can maintain a lifestyle that she had prior to divorce. Also in case of property received at the time of marriage husband and wife are entitled to equal halves. Having said this it must be borne in mind that in cases of divorce by mutual consent the such aspects are generally as per the agreement between parties.

Frankly speaking no one wants to pay the expenses which you bear until and unless he is under some pressure. You can claim maintenance or alimony as per your wish. If any FIR was lodged then you would have upper hand but if you want to divorce by mutual consent , you can seek a lump sum amount or take monthly expenses as per your convenience. You can also file an application before the court to direct the husband to return back all your jewellery articles and other goods as well.

If you are a girl and you wanted to divorce on mutual consent then it is your discreation to give consent after some term and conditions and certainly you will get all your articles and goods which you have gifted in your marriage.

well if there is div between husband and wife on the ground of mutual consent then there are chances.to settle the mAtter as the parties are interested hence can be settled but the laws is clear that gifted item can not be return force fully further I can contact personable.to lawyer or inline

Dear Sir, mutual consent is a kind of divorce in which both the parties agreed their terms mutually with their free consent. The terms are the results of negotiations you do before filing the petition. If the party is agreed to pay then you can otherwise you cannot pressurize to.

The court will decide. In Indian law, there is no provision for the return of wedding expenses. If the wife wishes to claim this money, she must prove that it was spent and can be defended.
