Can I and my daughter settle abroad without divorce or husbands approv

Dear Sir/Madam, I have been left by my husband 2.5 years ago in the same house at different floors(in laws house) when I found that he has relations outside marriage. I don't have any proofs for that. Last year I left that house along with my daughter. Since then, we are not in contact with anyone. I am living with my parents and looking after my daughter. I am a working woman . I want to know few things 1. What are my legal rights 2. What are the legal rights of my daughter 3. I invested in some property and other major things like car etc. for which I have no major proofs except the money is transferred to husband's account from my account. How can I get them back 4. How can infidelity and mental harassment be proved. 5. How should I go about divorce 6. Can I and my daughter settle abroad without divorce or approval of husband. Thanks

Dnt not worry. First of all i will talk about your legal rights you can claim maintainance from your husband for your expenses and for your daughter she can also claim montly maintainance fron her father for her day to day expenses. If you have transfered money to your husband account from yours for investment purpose thats sufficient proof to get it back.for the harassment you suffered you can file a case in court for domestic voilence and get claims from him. Yes you and your daughter can settle in abroad. Also therw are many other altenative that you can take and file case in court against your husband in order to get your rights back and to get things which are under his custody.

If you can convince your husband for a mutual consent divorce, it would be the best, thereafter you can settle abroad without the risk of inviting proceedings against you with respect to child custody etc. If he doesnt agree, then you can contest a divorce on grounds of cruelty. If you have sufficient proof of adultery, then you can seek divorce under the grounds of adultery. As far as your legal rights are concerned, you and your daughter have right of maintenance and can seek the same even without filing for divorce.
