23-Dec-2023 (In Divorce Law)
Hello, A marriage between hindu girl and christian boy has been registered on March,2015 under tamilnadu marriage act,2009. She was converted to christian as per paper. Is this marriage valid? Or it has to be registered under Special marriage act? If she files complaint against forceful conversion, this marriage becomes invalid?
Change of religion is one of the ingredients for divorce. If you want you can divorce her on the ground that she converted to other religion.

The marriage registration under Tamilnadu Marriage act 2009 might have been done following the procedures meant and on the basis of the facts that are essential for this purpose. Marriage meaning under this act is :
“marriage” includes all marriages performed by persons belonging to any caste or religion under any law for the time being in force, or as per any custom or usage in any form or manner and also includes remarriage.
Therefore there is no legal infirmity in this registration.
This marriage can be registered under Special marriages act also but since it has been already registered, there is no necessity for that. She can very well file a petition to annul the marriage since she has been forced to accept the marriage by forcibly converting her religion.
