Can divorce be filed on grounds of mental and economical torture

23-Feb-2023 (In Divorce Law)
My father mentally and economically tortures my mother and doesn't give her any money for her day to day expense. He is quite rich and accomplished but would make her beg for only a few hundreds. Also beats her some times and uses foul language. She wants to file for divorce as she feels it's hurting her self respect. They are married for 35 years. My mother is a housewife and has never worked because of domestic responsibilities but she has a bcom degree. Can she file for divorce and is she eligible for alimony?

Yes! she can file for divorce and ask for alimony. also if she does not want divorce and want to stay sepreate then she can file for maintenence. you have not mention your age in this. if you are minor then your father is liable to pay your maintenanace as well.

Yes you can file for Divorce as well as for maintenance for such type of behavior against her. Just have a talk again with your father and with your mother are they really willing to have divorce at this age which i suggest to not to get into litigation at this age. It will take lot of time one the Divorce Petition is filed. Hope to discuss with your parents and settle it within yourself which will be more better option to you. If it not works then give me a call i shall help you out on this.
