Can a man have a second marriage, if divorce not granted by magistrate

If you any one court registry marriage after he divorce by mutually on court paper and it authorized by advocate with written document and sign & photo copy afaixed both person but divorce is not conducted by register/magistrate on court. So he will be legally permitted to second marriage?

No both husband and wife have to file a mutual divorce petition before the District Judge and get hold of a divorce decree then only divorce is permanent and 2nd marriage permissible after 90 days. Before that such act would tantamount to bigamy.

If you are marriage registered under HMAct or SMAct then you have to file a mutual divorce in district court otherwise your is not complete . And you are not a allowed to marry 2nd time according to law. PLEASE MENTION YOUR RELIGION OTHHERWISE DIFFICULT to answer to your query.

No, without court order and decree to dissolve the marriage by divorce from a competent court of laws( not magistrate), second marriage is not possible. Failing of mutual consent divorce either party can file a separate suit for divorce on contest.

You can legally permitted to got Second Marriage after obtaining Decree of Divorce under Section 13(1) of Hindu Marriage Act or 13B of Hindu Marriage Act or Section 27 of Special Marriage Act, 1954 or Section 28 of Special marriage Act. In all Cases District Judge is the competent Authority or the Concern Family Court is the authority to pass such decree only.

The answer of your question is NO. If a marriage once registered then the tie will not be dismissed until and unless they got a decree of divorce before d district judge. So before getting a decree of divorce it is illegal to marry any other person.
