Brother sleeping every night in vehicle for 2.5years due to cruelty.

Hello sir /madam, i am from srilanka.My brother is 40 years old. He is married and having two children. There were some problems with his married women from last 3years.she is very cruel and don't know how to treat his partner. My brother is mentally down and he don't want to live with that cruel women anymore .he is not living together for past 2.5years.He slept every night's in his vehicle for past 2.5years.can he get the divorce under bed and board law?how long it will take to get this divorce. Kindly assist me.

He can file for divorce for cruelty. He can even file a police complaint. He has to Inform the police about the behaviour.

Assuming your brother and his wife are Hindu and staying in India except in the state of J&K, your brother can file a petition for divorce on the ground of cruelty and desertion under section 13(1)(ia) and 13 (1)(ib) of the Hindu Marriage Act. The Petition can be filed in the district family court having jurisdiction.
