Applied for mutual divorce husband not coming for second motion

I had applied for mutual consent divorce and first motion is completed in Jan 2017 now my husband is not coming on desired second motion date . Please suggest what can be done in this scenario.

Hi,
As per your settlement deed was there any clause for non appearance on second motion ?
There are certain judgements where second motion has been executed even on non appearance of one party.

The consent is valid for eighteen months from the date of 1st motion so try to resolve the matter amicably...otherwise u will have to contest the case before the court to get the divorce decree which will take some time for further information please contact us .

There is nothing you can do the main requirement of section 13B of the Hindu Marriage Act is free and mutual consent from both the parties and any party can withdraw that consent before the passing of the second motion

Your husband is exercising that right and u can't force him to appear
