Alimony/Maintenance in Contesting Suit if husband is not earning good.

Hi Just want to know what are the chances of getting Alimony/maintenance in Contesting Mat suit, if the husband is not earning or not financially stable? Though at the time of marriage, the girl's family spend lots of money in all the rituals & customs related to traditional marriage. The groom lied to girl's family about his financial position & earning capacity.
When a contested divorce is instituted, both parties require to submit an affidavit that has been directed by Justice Midha of Delhi High Court, where in all specifics regarding income and assets of both parties are to be filled in. It is the court's discretion to decide actually about your husband's financial situation after going through that affidavit. However destitute your husband might me, you are entitled to claim your stridhan back through maintenance. Stridhan is the property including your jewellery, furniture and household appliances that your parents gifted you during your marriage. You can claim all that in cash or kind. Apart from that whatever meagre amount your husband might be earning he has to give you half of that so as to ensure that you have a lifestyle, of you were still married and never divorced till the time you get married again.
